Dominion Road condo development gets two-year extension

As the housing market, and more specifically condo market, continues to struggle, Fort Erie councillors have somewhat reluctantly approved an extension to a draft plan of subdivision and draft plan of common elements condominium for a proposed project on Dominion Road.
Staff proposed approving a three-year extension for the project, as the applicants have several conditions they still need to clear. An amendment from Mayor Wayne Redekop reduced the extension to two years in an effort to put more urgency on the developers.
Redekop cited that 31 of the total 47 conditions have seen virtually no progress along with what has appeared to be a lengthy stall in work on the project as reasons for the amendment.
“Nothing has happened since February of 2025, so that’s a year and a half that’s gone by,” he said, referring to the last time the town issued comments on applications from the owners.
The project, located at 3303 Dominion Road, includes “13 freehold townhouse units and a common elements condominium containing the private road, visitor parking and landscaped areas,” the staff report said.
Council approved the draft plan of subdivision and draft plan of common elements condominium in August 2023, including several conditions that need to be satisfied first. That approval was set to lapse later this month.
Councillors have dealt with a couple of draft plan extensions in recent months, meeting the requests with a mixture of understanding and frustration as a weak market has bumped up against their desire to get new housing built.
“I don’t like kicking the can down the road, but at the same time I understand there’s a practical reality that everyone has to face when market forces don’t go the way they intend,” said Councillor Nick Dubanow.
Director of Planning, Building and By-law Services Anamika Dilwaria told councillors the developers have indicated they’re committed to moving forward with the project, but a weak market has made things difficult.
With the new reduced extension, the applicants will have to come back in 2028 should they need more time. Redekop said at that time council can decide if they’ve made a reasonable effort to clear the remaining conditions.
If all conditions are not cleared at that time, a further extension could be granted if council deems the developers made a good faith effort to move the project forward.
